User Agreement 
Welcome and congratulations on your membership to BESTMEDVALUES.com. This Agreement constitutes your agreement with BESTMEDVALUES for your membership to its membership (the "Service") with respect to your use of the Service. You must agree to abide by all of the terms and conditions contained in this Agreement in order to become or remain an authorized user of the Service. As used in this Agreement, "we" and "us" mean BESTMEDVALUES or any successor or assign of BESTMEDVALUES.

Please read the following terms and conditions carefully, as they form the agreement between us. If you do not agree to these terms and conditions, you may not use the service and should not proceed to register. By using the Service after December 1, 2009 you are agreeing to be bound by this Agreement, including all amendments made to date.

Terms of use

Any and all use of BESTMEDVALUES.com constitutes acceptance of any and all terms of service. We offer several different membership packages that allow members to access information on BESTMEDVALUES.com. Membership packages may allow members to access information for various time intervals. Time intervals may include one (1), three (3), and six (6)month intervals. The amount charged to you is based on your choice of package and charged to the account of your choice. You also understand and agree that the service may include certain communications from BESTMEDVALUES, our partners, and affiliates such as service announcements, offers, administrative messages and the BESTMEDVALUES Newsletter, and that these communications are considered part of BESTMEDVALUES membership. Should you decide that you do not wish to receive communications, you will be able to opt out of receiving them.

Each member’s activity on our site is monitored to prevent ‘Friendly Fraud’. Friendly fraud is when a person joins our website, accesses the information in the members area and then asks for a refund or threatens to charge back. Use of our website entitles us to receive payment. Upon receiving any requests for refunds and/or chargebacks, we will provide the necessary bank or agency with a detailed member activity history. Banks DO accept these logs as proof that we provided service enough to justify payment. If you have EVER logged into our members area or used our website in any way, please do not even try to refund or chargeback.

Some memberships may automatically renew at the end of their term unless otherwise specified. It is each Member's responsibility to cancel prior to the renewal date if the membership is to be terminated. By joining BestMedValues.com, you agree and understand that this is an Automatic Renewing Membership unless otherwise specified. You must give notice in advance of the renewal date and time in order to cancel. It is every user’s responsibility to cancel each of his or her membership. We will not be held responsible for memberships which are not canceled in a timely manner due to the fact that the individual did not send an e-mail submitted through the “Contact Us” system on the website. Valid cancellations can only be accepted through the Contact Us system. Transactions are done securely through our authorized sales processing agent. Your information will be transmitted through Secure Socket Layer (SSL) software to ensure your information is private. Members will receive unlimited access to all information listed on BESTMEDVALUES.com. You will also receive unlimited access to our support resources.

In order to become a member of BESTMEDVALUES.com, you must provide us with information that will help us identify you as a member. Upon successfully joining, you will be issued a password that will allow you to access the information in our site. It is your responsibility to notify us of any changes in your personal information. You agree to immediately notify BESTMEDVALUES of any unauthorized use of your password or account or any other breach of security, and ensure that you exit from your account at the end of each session. Any failure to do so will result in immediate termination of membership without refund.                                              No Right of Survivorship and Non-Transferability. You agree that your BESTMEDVALUES account is non-transferable and any rights to your BESTMEDVALUES I.D. or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.

No Warranties

The Service is distributed on an "as is" basis. We do not warrant that this Service will be uninterrupted or error-free. Due to the constant fluctuation in medication prices, prices listed on the site can change at any time and we are not responsible if a current price listed is incorrect or cannot be found at any of the online pharmacy sites we list. There may be delays, omissions, and interruptions in the availability of the Service. Where permitted by law, you acknowledge that the service is provided without any warranties of any kind whatsoever either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. You acknowledge that use of the Service is at your own risk. We do not represent or endorse the accuracy or reliability of any software, programs, advice, opinion, statement or other information displayed, uploaded or distributed through the service, our partners or any user of the service or any other person or entity. You acknowledge that any reliance upon any such opinion, advice, statement or information shall be at your sole risk. Your continued use of the service now, or following the posting of notice of any changes in this Agreement, will constitute a binding acceptance by you of this Agreement, or any subsequent modifications.

Right to Use

Your right to use the Service is subject to any limitations, conditions and restrictions established by us from time to time, in our sole discretion. We may alter, suspend or discontinue any aspect of the Service at any time, including the availability of any Service feature, database or content. We may also impose limits on certain features and aspects of the Service or restrict your access to parts or all of the Service without notice or liability.

Purchasing by a minor

For the protection of our shoppers, it is our policy to not sell to minors under any circumstance. You represent, warrant and covenant that you are at least 21 years old.

Legal use of the service

It will be your responsibility to use the information provided through the Service in a legal manner, respecting all laws including copyright infringement and trade laws and any other law applicable to your use of the service. All contents of BestMedValues.com are provided for informational purposes only. You agree that the Service should not be interpreted as medical advice, as an endorsement of any web site/listing/source, or as any statement or opinion in regards to healthcare in general. Although the online pharmacies we list are licensed & employ licensed pharmacists, we are not medical professionals, pharmacists, and hold no medical related licenses of any kind. We do not provide health or medical advice. We solely provide information. Any person seeking medical advice of any kind should consult a licensed physician. Remarks and data comprising the Service are for informational purposes only and are provided without warranty of any kind. BESTMEDVALUES declines all responsibility related to your use of the information and services provided. Any illegal use of the information provided in BESTMEDVALUES.com is prohibited and will result in immediate termination of membership without refund. 
Indemnification; Governing Law; Jurisdiction: You agree to defend, indemnify, and hold us, our employees, and other representatives harmless from and against all liabilities, damages, claims, actions, costs, expenses (including attorneys fees), in connection with or arising from the Service and/or your breach of this Agreement. 
This Agreement is personal to you, and you may not assign your rights or obligations to anyone. If any provision of this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.

Membership fees and charges

You agree to pay or have paid all fees and charges incurred in connection with your membership with the service (including any applicable taxes) at the rates in effect when the charges were incurred. All fees and charges are nonrefundable. We may change the fees and charges in effect for using the service and may conduct changes on the site from time to time. You also are responsible for any fees or charges incurred to access the service through an Internet access provider or other third party service, including but not limited to telephone charges. YOU ARE SLOELY RESPONSIBLE FOR PAYING ANY AMOUNTS BILLED TO YOUR CREDIT CARD BY A THIRD PARTY, WHICH WERE NOT AUTHORIZED BY YOU. Any violations of our Terms of Service will result in immediate termination of membership without refund.
